Terms and Conditions

This Terms of Service Agreement ("Agreement") is entered into between you ("User", "you", or "your") and HSPAY.io, a global digital service platform operated by an international private entity. This Agreement governs your access to and use of all services provided through the HSPAY.io Platform, including www.hspay.io, related APIs, web applications, and other integrated technologies (collectively, the "HSPAY.io Platform" or "Services").

By accessing or using the HSPAY.io Platform, you acknowledge that you have read, understood, and agreed to be bound by this Agreement and our Privacy Policy. If you do not agree, you must discontinue the use of all HSPAY.io Services immediately.

1. General Provisions

1.1 This Agreement establishes a legally binding contract between you and HSPAY.io.

1.2 The Services include but are not limited to wallet management, internal transfers, referral programs, third party integrations, staking, and other crypto based financial features.

1.3 By using any part of the HSPAY.io Platform, you acknowledge that this Agreement applies in full.

1.4 You confirm that you are of legal age and have full capacity to enter into this Agreement according to the laws of your jurisdiction.

1.5 All references to HSPAY.io include its legal owners, partners, affiliates, directors, developers, and employees acting under its authority.

2. Account Eligibility and Registration

2.1 To use HSPAY.io, you must create an account using accurate and valid information including a correct email address and username.

2.2 Depending on the service level, you may be required to complete verification steps to comply with global financial regulations.

2.3 You must not create multiple accounts, share login credentials, or use automated bots or scripts to access our systems.

2.4 HSPAY.io operates worldwide but does not operate or offer services within the territory of India. Users located in India or using Indian IP addresses are restricted from accessing the platform. HSPAY.io does not maintain offices, representatives, or operational infrastructure in India.

2.5 You are responsible for protecting your account credentials. HSPAY.io is not liable for any unauthorized access resulting from negligence.

2.6 Any updates to your contact details must be made promptly in your account settings. HSPAY.io is not responsible for missed communications due to outdated information.

3. Account Restrictions and Termination

3.1 HSPAY.io reserves the right to suspend, freeze, or terminate any user account at its discretion in cases of suspected illegal activity, policy violations, or fraudulent behavior.

3.2 Duplicate or suspicious accounts may be reviewed or merged, and administrative fees may apply in certain cases.

3.3 If HSPAY.io receives legal or regulatory requests regarding your account, access may be temporarily limited until the matter is resolved.

3.4 Additional administrative or investigation charges may apply for user misconduct or system abuse.

4. Risks

4.1 Software Risk: HSPAY.io operates using blockchain technology which is experimental and may involve bugs or unexpected behavior.

4.2 Regulatory Risk: Legal changes in any jurisdiction may affect access to certain services or their availability.

4.3 Market Risk: Cryptocurrencies are volatile and may lose significant value without warning.

4.4 Security Risk: Accounts may be compromised through phishing, malware, or user error. HSPAY.io is not responsible for user-side breaches.

4.5 Forks and Upgrades: In case of blockchain forks, HSPAY.io may suspend affected services temporarily.

4.6 Tax Responsibility: Users are fully responsible for managing their tax obligations under their local laws.

5. Exchange and Transactions

5.1 HSPAY.io may provide digital currency exchange or swap features that allow users to convert supported currencies.

5.2 Transactions initiated by users are considered final and irreversible once confirmed.

5.3 Exchange rates and fees are dynamic and may change without notice due to market conditions.

5.4 HSPAY.io is not responsible for losses caused by external blockchain delays, congestion, or network issues.

6. Warnings and Disclaimers

6.1 Cryptocurrency use and investment are high risk and may result in total loss.

6.2 HSPAY.io does not provide financial advice or investment guarantees.

6.3 Digital assets are not legal tender and are not insured or backed by any government authority.

6.4 HSPAY.io disclaims responsibility for third party services or tokens integrated through external APIs.

6.5 By using HSPAY.io, you acknowledge and accept all related risks.

7. Service Scope

7.1 Wallet Services: HSPAY.io allows users to deposit, store, and withdraw supported cryptocurrencies. Transactions are final once confirmed on the blockchain.

7.2 Availability: Service access may be limited during maintenance, upgrades, or high network load.

7.3 Third Party APIs: HSPAY.io integrates with certain third party systems but is not responsible for their performance or conduct.

7.4 KYC and AML Compliance: HSPAY.io may request user verification documents in accordance with global standards. Noncompliance may result in account restrictions.

7.5 Limitation of Liability: HSPAY.io provides services "as is" and limits total liability to the lesser of 100 USD or the total fees paid by the user.

7.6 Indemnification: You agree to indemnify and hold harmless HSPAY.io, its affiliates, and staff against claims arising from your actions on the platform.

8. Miscellaneous

8.1 HSPAY.io may temporarily suspend or modify services without prior notice for maintenance or security reasons.

8.2 Promotional programs, bonuses, and campaigns may be altered or discontinued at any time.

8.3 Invalidity of any clause does not affect the remaining provisions of this Agreement.

8.4 HSPAY.io reserves the right to amend these Terms periodically. Continued use of the Platform constitutes acceptance of updates.

8.5 This Agreement is governed by applicable international commercial laws. Any disputes shall be handled in a neutral international jurisdiction chosen by HSPAY.io.

9. Regional Limitation Notice

HSPAY.io operates globally with customers and partners around the world. However, the platform does not operate or provide services within the jurisdiction of India and does not maintain any business, physical presence, or commercial activity under Indian law. Access from Indian territory is restricted and users located there are advised not to use the platform.
